Ho ho ho! Deadline for director IDs extended til 14 December.

Just when you thought you were out of time for your director ID number, the deadline for existing company directors to apply for your director ID number has now been extended by the Australian Business Registry Services (ABRS) from 30 November, to 14 December 2022. No action will be taken in relation to the late application.

This means that if you are currently a company director and have not yet applied for your director identification number, YOU HAVE UNTIL 14 December 2022 to do so.

As mentioned in our update of 21 September 2022, a director identification number is a unique identification code. Once you have one, you will have it for life and must provide it to all the companies of which you are or become a director. The regime applies to directors of Australian companies and of other ASIC-registered entities (such as registered foreign companies, incorporated associations with an Australian Registered Body Number and incorporated charities), and all new company directors must now apply for an identification number before being appointed.

A failure to have a director identification number when required is an offence under section 1272C of the Corporations Act 2001 (Cth), and both civil and criminal penalties may apply (with a maximum criminal penalty of $13,200 and a maximum civil penalty of $1,100,000).

Further information about the process of applying for a DIN is available directly on the ABRS website: https://www.abrs.gov.au/director-identification-number/apply-director-identification-number. Please let us know if you have any questions.
